Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, CRM software, client portal, mobile applications, APIs, artificial intelligence features, digital marketing services, Pay After Sale (PAS) Growth Partnership services, hosting, and related products and services ("Services") provided by Infoskaters Technologies Pvt. Ltd. ("Infoskaters", "we", "our", or "us"). By using our Services, you agree to these Terms.

1. Eligibility

You must have legal authority to enter into these Terms on behalf of yourself or the organization you represent.

2. Services

Our Services may include CRM software, lead management, sales automation, marketing automation, AI-powered features, websites, mobile apps, custom software, hosting, consulting, digital marketing, SEO, advertising management, analytics, integrations and related professional services.

3. Client Accounts

You are responsible for maintaining account security.
You are responsible for activities performed using your account.
You must provide accurate information.
We may suspend accounts that violate these Terms.

4. CRM Platform

The CRM is provided as a software platform to help manage customer relationships, leads, orders, invoices, communications and business workflows.

Client data remains the client's property.
Infoskaters acts only as the software provider and processor of client data where applicable.
Clients are responsible for obtaining all required customer consents before storing personal information.
Clients are responsible for managing user permissions within their organization.

5. Third-Party Integrations

The Services may integrate with Meta, Facebook, Instagram, Google, WhatsApp Business, Microsoft, Zapier, Make, Pabbly Connect, payment gateways, email providers and other third-party platforms. Continued availability depends on those providers and may change without notice.

6. Meta and Google Services

By connecting your Meta or Google accounts, you authorize Infoskaters to access only the permissions required to provide requested functionality such as importing leads, displaying campaign metrics, analytics, conversion data and reporting. You remain responsible for complying with Meta and Google platform policies.

7. Artificial Intelligence Features

AI features are intended to assist users. AI-generated content may be incomplete or inaccurate and should be reviewed before use. AI output does not constitute legal, financial or professional advice.

8. Pay After Sale (PAS) Growth Partnership

PAS is a commercial growth partnership under a separately executed proposal or agreement.

Commercial terms, commissions and payment schedules are defined in the signed proposal.
Client must provide required access to websites, CRM, advertising platforms and analytics tools.
Client remains responsible for products, pricing, fulfillment, taxes, customer support and legal compliance.
Marketing outcomes depend on multiple external factors. Except where expressly agreed in writing, Infoskaters does not guarantee specific revenue or sales results.

9. Acceptable Use

You must not use the Services for unlawful activities, spam, malware distribution, phishing, copyright infringement, unauthorized access, reverse engineering, excessive automated abuse or any activity that disrupts the Services.

10. Fees and Payments

Subscription fees, one-time license fees and professional service fees are payable according to the applicable quotation, proposal or invoice. Late payments may result in suspension of Services.

11. Refund Policy

Software licenses are generally non-refundable after activation.
Domain registrations, SSL certificates and hosting are non-refundable after provisioning.
Third-party fees are non-refundable.
Professional services are billed based on work completed unless otherwise agreed.
PAS engagements follow the executed commercial agreement.

12. Intellectual Property

All intellectual property relating to our software, source code, designs, trademarks, documentation and platform remains the property of Infoskaters or its licensors. Client business data remains the client's property.

13. Availability

We strive to provide reliable Services but do not guarantee uninterrupted availability. Scheduled maintenance, emergency maintenance and third-party outages may affect availability.

14. Security

We implement reasonable technical and organizational safeguards; however, no system can guarantee complete security.

15. Suspension and Termination

We may suspend or terminate Services for non-payment, security risks, abuse, unlawful activities or violation of these Terms. Upon termination, access may be removed and data retention or deletion will be handled according to our policies and applicable agreements.

16. Limitation of Liability

To the maximum extent permitted by law, Infoskaters shall not be liable for indirect, incidental, special, consequential or lost-profit damages arising from the use of the Services. Our aggregate liability shall not exceed the amount paid by the client for the affected Services during the twelve months preceding the claim, unless applicable law requires otherwise.

17. Indemnification

You agree to indemnify and hold Infoskaters harmless against claims arising from your misuse of the Services, violation of these Terms or infringement of third-party rights.

18. Changes

We may update these Terms from time to time. Continued use of the Services after publication of updated Terms constitutes acceptance of the revised Terms.

19. Governing Law

These Terms are governed by the laws of India. Courts having jurisdiction over Infoskaters Technologies Pvt. Ltd. shall have exclusive jurisdiction unless otherwise required by applicable law.
